Modification hearings are reserved for applicants who believe they have experienced a hardship that would warrant a reduction in the outstanding fines. Only Code and Building liens are eligible for modification hearings and before an application can be reviewed all violations on the subject property must be in compliance.
Modification requests must be made by the violator or the owner of the violating property. Exceptions will be made when modification application is accompanied by a notarized limited power of attorney form signed by the current owner authorizing another party to represent on their behalf.
There is no guarantee that a modification will be granted, that decision will be the sole authority of the Special Magistrate.
A hardship letter detailing the reason for your modification request must be submitted with this application. This is your opportunity to explain in detail the reason you feel the fines should be reduced.
Modification hearings occur every other Wednesday. Please allow 3 – 5 days for processing and once processed you will be contacted and given a date and time for your appearance.
There is a $350 non-refundable application fee for this request.
